What happens if you are not successful in my case?
We operate on a contingency basis. Meaning, we are only paid upon the successful recovery of your money. You will never be billed for any cost or expense associated with the case. In addition, we cover all costs that are incurred during the process of your recovery. This includes all legal representation when necessary. Because of this practice, we are selective about the cases we take on. Once we've reached out to you, we have already determined that we have a strong case for your claim and are prepared to partner with you in pursuing justice for your loss!
Can I get my property back?
State laws vary on redemption periods when real property is sold at auction. Once a transfer of ownership has taken place and has been recorded, redemption is typically not possible.
Do you request my social security number?
It is our policy not to request or accept any information that is potentially compromising to us, and/or our clients. Having or requesting such information creates a liability issue and more importantly, we want our clients to feel 100% secure in all exchanges.
How do you determine how much money I have coming from the Government?
The amount is determined based upon the amount being owed on delinquent payments and the amount that the property was purchased for. These amounts include back taxes, mortgage payments, IRS and DSHS liens, creditor/debtor and additional junior liens, the foreclosure sale costs and many other factors. We have extensive knowledge about the policies that govern these funds, as well as the rights of our clients who have been foreclosed upon.
If the owner of the property is family and is deceased, am I eligible for these funds?
When the recorded owner of real property passes away, the property becomes a part of their estate. Depending on the location of the property and place of residence of the decedent, there are various filings that can take place that allow heirs or successors to settle the estate and collect these funds. These processes vary from state to state. Our office has extensive experience in these types of filings and a highly knowledgeable team of attorneys in cases where legal representation is needed. In accordance with our contingency agreement, all expenses associated with attorney representation are covered and in the unlikely event that we are unsuccessful, you owe us nothing for our time or expenses. We are only compensated upon the successful recovery of your funds.
How long does the process to receive the funds take?
The timeframe will depend on several factors which include: the source of the foreclosure, (ie: tax foreclosure, mortgage foreclosure, creditor/debtor foreclosure etc.) the time elapsed since the sale of the property, whether probate/an estate is involved and several other factors that can either extend or, in many cases shorten the amount of time that it takes to process the case. On average, it will take 90 days from start to finish.
How long do I have to decide if I want your services? What happens to the funds?
Statutes of limitations exist, that govern and limit the amount of time that we have to file a case. Once the statute expires, the funds will escheat to the courts, government, bank, etc.. If this happens, there is no longer an opportunity to collect on those funds. Statutes vary from state to state, however, most range from 1-3 years.
That being said, there is never any pressure from us. We are here to help those who are in need of compassionate advocacy and it is our highest priority that our clients feel confident and secure in our partnership. We cannot guarantee success, but we do promise to fight every battle with tenacious integrity and unwavering persistence.
